General Principles of Returns and Refunds in Romania

In România, consumer rights concerning the return of goods and services are governed by various legislative acts, including Government Emergency Ordinance no. 140/2021 on certain aspects of contracts for the sale of goods, as well as the Civil Code. While the traditional right of withdrawal (14 days) often applies to physical goods purchased online, the specifics can differ for digital products and services.

For digital content not supplied on a tangible medium (e.g., downloadable e-books, streaming videos, online courses accessed immediately), the consumer's right of withdrawal may be limited if the performance has begun with the consumer's express prior consent and acknowledgment that they lose their right of withdrawal. However, this does not preclude refunds in cases of faulty products, services not rendered as described, or other breaches of contract by the seller.

Our Specific Return and Refund Conditions

MSF Dietetics & Fitness S.R.L. aims to provide a fair and efficient process for any returns or refund requests. Our policy is structured as follows:

1. Refunds for Digital Products (Non-Tangible)

For digital products such as e-books, downloadable guides, or pre-recorded video content, we offer refunds under the following circumstances:

  • Product is not as described: If the digital product you received is significantly different from its description on our website, or if it contains material errors or omissions that hinder its intended use.
  • Technical issues preventing access or use: If you encounter persistent technical difficulties in downloading, accessing, or using the digital product that cannot be resolved by our support team.
  • Accidental duplicate purchase: In cases where a customer accidentally purchases the same digital product multiple times, a refund can be issued for the duplicate purchase upon verification.

Important Note: We generally do not offer refunds for digital products if you simply change your mind or if you have already accessed or downloaded the product, as per the limitations on the right of withdrawal for digital content not supplied on a tangible medium, where performance has begun with your consent. However, we will always assess each situation on a case-by-case basis to ensure customer satisfaction.

2. Refunds for Online Consultations and Coaching Sessions

For personalized online consultations and coaching sessions, the following conditions apply:

  • Cancellation by the client:
    • If you need to reschedule or cancel an appointment, please provide at least 24 hours' notice. Cancellations made with more than 24 hours' notice will be fully refunded or can be rescheduled at your convenience.
    • Cancellations made with less than 24 hours' notice may be subject to a cancellation fee or may not be eligible for a full refund, at the discretion of MSF Dietetics & Fitness S.R.L., to account for the time allocated and the inability to offer the slot to another client.
  • Cancellation by MSF Dietetics & Fitness S.R.L.: In the unlikely event that MSF Dietetics & Fitness S.R.L. needs to cancel a scheduled consultation or coaching session, you will be offered a full refund or the opportunity to reschedule at a mutually agreeable time.
  • Dissatisfaction with the service: While we strive for excellence, if you are genuinely dissatisfied with the quality of a consultation or coaching session, please contact us within 48 hours of the session. We will review your case and may offer a partial or full refund, or a complimentary follow-up session, depending on the circumstances.

3. Refunds for Subscription Services

For subscription-based services, refunds are typically processed for the current billing period under the following conditions:

  • Cancellation of subscription: You can cancel your subscription at any time. Your cancellation will be effective at the end of your current paid billing period. No refunds will be issued for partial subscription periods already paid for, but you will retain access until the end of that period.
  • Service interruption or unavailability: If the subscription service becomes unavailable for a significant period due to technical issues on our end, we may offer a pro-rata refund for the affected time.
  • Unsatisfactory service: If you believe the subscription service is not meeting the described standards, please contact us to discuss your concerns. We will investigate and may offer a refund based on the specific issues encountered.

4. Refunds for Webinars and Online Workshops

For live webinars and online workshops:

  • Cancellation by the client: If you cancel your registration at least 48 hours before the scheduled event, you will receive a full refund. Cancellations made less than 48 hours before the event may not be eligible for a refund, as resources and access may have already been allocated.
  • Event cancellation by MSF Dietetics & Fitness S.R.L.: If we cancel a webinar or workshop, you will receive a full refund.
  • Technical issues: If you are unable to attend due to unforeseen technical difficulties on your end that are not resolvable, please contact us. We may offer a refund or access to a recording if available.
